1. Purpose & Cultural Stewardship

The Trail of Tears II Experience (“Trail of Tears II”) is a historically grounded, educational, and cultural initiative that honors Indigenous history, the legacy of Black Wall Street, and the resilience of communities impacted by forced displacement, systemic injustice, and economic violence.

By accessing this Site or participating in Trail of Tears II activities, you acknowledge that:

This initiative involves sacred history and living communities.

All oral histories, archival imagery, and ancestral narratives must be treated with respect, dignity, and integrity.

Unauthorized commercial appropriation, rebranding, or resale of project materials is strictly prohibited.


2. Acceptance of Terms

By accessing www.trailoftears2.com, registering for events, submitting donations, purchasing tour packages, or enrolling as a volunteer, you agree to be bound by these Terms of Service. If you do not agree, you must discontinue use of the Site immediately.


3. Payment Processing & Fiscal Handling

All financial transactions -including charitable donations and experience fees, are processed via Can We Play, Inc., a 501(c)(3) nonprofit organization.

Third-Party Processing: By submitting payment, you acknowledge that your financial data is processed by Can We Play, Inc. and is subject to their privacy and security protocols.

Transaction Receipts: Official receipts for tax purposes or proof of purchase may be issued under the name of Can We Play, Inc. on behalf of Wall Street II Tulsa North Foundation, Inc. (“WSII”).


4. Donations & Charitable Contributions

WSII is a Maryland-based nonprofit organization.

Donations are processed by Can We Play, Inc. and are tax-deductible to the extent permitted by law.

Non-Refundable Policy: Donations are final. WSII and Can We Play, Inc. will only process refunds for documented duplicate charges or bank errors reported within 30 days.

Legal Clarification: Charitable donations are separate from service fees. A donation does not grant the donor travel seats, lodging, or event admission.


5. Paid Tour Packages & Experience Fees

Fee-based offerings consist of motorcoach transportation, hotel accommodations, guided tours of the Greenwood District, catered meals, and program materials.

Payment Collection: All tour and event fees are collected by Can We Play, Inc.

Refunds: Paid experiences are governed by the specific Refund Schedule provided at the time of purchase.

Code of Conduct: Participation is contingent upon signing a Liability Waiver and Code of Conduct. Removal for behavioral violations results in forfeiture of all fees.


6. Third-Party Providers

WSII and Can We Play, Inc. contract with independent third parties for transportation (charter bus companies) and lodging (hotels). Neither organization is responsible for injury, loss, or damage caused by the acts or omissions of these third-party providers.


7. Travel, Route Modifications & Force Majeure

WSII reserves the authority to modify travel routes, schedules, venues, and speakers due to severe weather, mechanical failure, government mandates, or public health emergencies. WSII shall not be liable for delays or cancellations caused by acts of God beyond its reasonable control.


8. Health, Safety & Medical Consent

Conduct: Participants must follow all staff instructions and maintain respectful conduct toward elders and community members.

Emergency Care: In a medical emergency, you authorize WSII staff to secure treatment (hospitalization or anesthesia) if you are unable to provide consent. You are responsible for all costs associated with such medical care.


9. Media & Recording Consent

By participating, you grant WSII the perpetual, worldwide right to capture and use your likeness and voice via photography, video, and audio for educational, archival, and fundraising purposes without financial compensation. Written requests for media exclusion must be submitted 14 days prior to the event.


10. Communications

By providing contact information, you consent to receive transactional updates, safety alerts, and newsletters via email and SMS. You may opt out at any time by using the "Unsubscribe" link or replying "STOP" to SMS.


11. Intellectual Property

The name "Trail of Tears II Experience," all logos, branding, and educational curricula are the exclusive property of WSII. Unauthorized reproduction is prohibited.


12. Limitation of Liability & Indemnification

Liability: WSII, its officers, and its partners (including Can We Play, Inc.) are not liable for direct or indirect damages, injuries, or losses resulting from interstate travel.

Indemnification: You agree to indemnify WSII and Can We Play, Inc. from any claims or legal fees arising from your conduct or breach of these Terms.


13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Maryland. Any disputes shall be resolved through binding arbitration in Baltimore, Maryland, administered by the American Arbitration Association (AAA).
